Terms of Use

These Terms of Use (hereinafter referred to as the “Terms”) set forth the conditions for the use of the smartphone application “VANXII” (hereinafter referred to as the “App”) provided by YELO LLC (hereinafter referred to as the “Company”). All customers who use the App (hereinafter referred to as the “User”) agree to these Terms before using the App.

1. Scope of Application
   1.1 These Terms apply to all actions taken by the User in relation to the use of the App.
   1.2 By agreeing to these Terms, the User consents to be bound by all conditions set forth herein.

2. Conditions of Use
   2.1 The App is provided free of charge. However, any expenses necessary for using the App (such as communication charges) shall be borne by the User.
   2.2 When using the App, the User shall not infringe the rights or interests of others, nor engage in any actions that violate public order and morals or any applicable laws and regulations.
   2.3 When using the App in public spaces, the User shall exercise care to avoid causing inconvenience or discomfort to others. The Company assumes no responsibility for any damage or disputes caused by the User to third parties.
   2.4 The User shall not use the App to create digital graffiti on private property or in places where it is not permitted.
   2.5 The use of the App does not require account information. However, the Company may use information obtained through the App for improving the App’s functionality and quality. By using the App, the User agrees to this utilization of usage information.

3. Intellectual Property Rights and Handling of Works
   3.1 All copyrights, trademarks, and other intellectual property rights related to the contents, functions, programs, and designs provided within the App belong to the Company or the rightful rights holders.
   3.2 The User retains copyright and related rights to any preview images or works (AR digital graffiti) created or displayed within the App. The User is free to reproduce or otherwise utilize these works. However, the User shall do so at their own responsibility and ensure that no third-party rights are infringed.

4. Prohibited Conduct
   In using the App, the User shall not engage in any of the following acts:

   • Acts that violate any laws or these Terms

   • Acts that infringe upon the rights, interests, or honor of the Company, other Users, or third parties

   • Acts that are contrary to public order and morals

   • Criminal acts or preparatory acts to commit crimes

   • Unauthorized access to, or imposing excessive loads on, the Company’s servers, networks, etc.

   • Any other acts that the Company deems inappropriate

5. Disclaimer
   5.1 The Company does not guarantee the accuracy, completeness, usefulness, or fitness for a particular purpose of the App’s operation. The User shall use the App at their own risk.
   5.2 Except in cases of willful misconduct or gross negligence on the part of the Company, the Company bears no responsibility for any damages (including indirect, special, or consequential damages, and lost profits) resulting from the use of the App.
   5.3 The Company assumes no responsibility for any disputes, problems, or damages arising between the User and a third party as a result of the User’s use of the App.

6. Modification, Suspension, Interruption, and Termination of the App
   6.1 The Company may, without prior notice to the User, change the content of the App or discontinue its provision at any time.
   6.2 The Company may temporarily suspend the provision of the App due to maintenance, system failures, changes in the system, natural disasters, communication line disruptions, or other circumstances.
   6.3 The Company shall bear no responsibility for any damage incurred by the User due to the modification, suspension, interruption, or termination of the App under this article.

7. Changes to the Terms
   7.1 The Company may change these Terms as necessary without prior notice to the User.
   7.2 If the User uses the App after changes to these Terms have been made, the User is deemed to have agreed to the revised Terms.

8. Handling of Personal Information
   The handling of personal information and usage data obtained through the use of the App shall be in accordance with the Company’s Privacy Policy.

9. Governing Law and Jurisdiction
   9.1 The interpretation and application of these Terms shall be governed by the laws of Japan.
   9.2 In the event of any dispute arising from or related to the use of the App, the court having jurisdiction over the location of the Company’s headquarters shall be the exclusive agreed court of jurisdiction.

10. Effective Date
    These Terms shall come into effect on December 1, 2024.
